How to report corruption through Lokpal?

Lokpal means “defender of people” or “people’s friend”. The Lokpal is the first institution in independent India, initiated to scrutinise and investigate accusations of corruption against public servants. The Lokpal and Lokayukta act was passed in 2013 following the Jan Lokpal movement by Anna Hazare in 2011. The Lokpal is liable for examining corruption at the national level, while the Lokayukta performs the same at the state level. 

Organisational Structure

Lokpal will have two main branches and will discharge its functions through these two.

  • The Administrative branch will be headed by an officer of the rank of secretary to govt of India and will have in its fold:

    • Inquiry/ Investigation branch to be headed by an officer, not below the rank of additional secretary to govt of India

    • Prosecution wing to be headed by an officer, not below the rank additional secretary to govt of India

    • Central Registry

    • Scrutiny wing

    • Establishment, Coordination, Media and Publication

    • Budget, Finances and Accounts 

  • The judicial branch will be headed by a judicial officer of the appropriate level and will assist the Lokpal to discharge their judicial functions.

Against whom can we file a Lokpal complaint?

Complaint can be filed against-

  1. Any person who is or has been a prime minister (with some exclusion which relates to international relations, external and internal security, public order, atomic energy, and space).

  2. Any person who is or has been a minister of the union.

  3. Any person who is or has been a member of either house of parliament.

  4. Any person who is or has been a Group ‘A’ or Group ‘B’ officer or equivalent serving in connection with the affairs of the government of India.

  5. Any person who is or has been a Group ‘C’ or Group ‘D’ official or equivalent serving in connection with the affairs of the government of India.

  6. Any person who is or has been a chairperson, member, officer, or employee in any board, corporation, authority, company, society, trust, or autonomous body established by an act of parliament wholly or partly established by the government of India.

  7. Any person who is or has been a director, manager, secretary, or other officers of any society, association of persons or trust registered wholly or partly financed by the government of India and the annual income of which exceeds such amount as the central government may by notification, specify presently Rs 10 lakh.

  8. Any person who is or has been a director, manager, secretary, or other officers of any society, association of persons or any trust registered under the law and is in receipt of any donations from any foreign source under Foreign Contribution(Regulation) Act, 2010 over Rs.1 crore rupees in a year.

How to file complaint to Lokpal online?

Follow the below steps to file complaints through the official portal.

  • Visit Lokpal Official Portal

  • Click On the “Complaint Corner” on top of the homepage

  • Select “Lodge A Complaint”

  • If you are filing a complaint about the first time register with an email id and a password

  • Once you registered, log in with the email id and password

  • Click on the “Lodge a new complaint” on the dashboard for the complainant.

  • There will be forms of  Part wise entry of complaint ( PART A, PART B, PART C and PART D )

PART A ( FOR INDIVIDUAL COMPLAINANT )

  • Fill the details with the Identity proof and Residential proof

PART B ( COMPLAINT IS BEING FILED ON BEHALF OF A BODY OR   BOARD OR CORPORATION OR AUTHORITY OR COMPANY, SOCIETY OR ASSOCIATION OF PERSONS OR TRUST OR LIMITED LIABILITY PARTNERSHIP)

  • Fill the details with essential documents

PART C

  • Enter the details of the corrupt with the proof of the allegation.

PART D

  • Fill the affidavit with necessary details

After filing the complaint online, a physical copy is to be submitted within a period of 15 days by post, courier or by hand to the lokpal office at the following address:

Lokpal of India,

Plot No-6, Phase II,

Institutional Area, Vasant Kunj,

New Delhi-110070.

NB: At the top of the envelope, 'Complaint to the Lokpal of India under Lokpal and Lokayuktas Act-2013' should be written clearly.

How to file complaint to Lokpal through email?

A complaint can also be sent by email to the email address complaint-to-lokpal@gov.in

 The subject of the email should be written as “Complaint to the Lokpal of India under Lokpal and Lokayuktas Act 2013”

  NB:

  • Complaints sent to any other address may not be entertained.

  • The complaint should be written in English only.

  • If a complaint is filed through email, a hard copy must be submitted to the Lokpal of India within 15 days from the date of filing.

How Part C is to be filled up in case of more than one public servant is involved in a complaint?
A separate sheet of Part C is to be enclosed with the complaint form for each public servant against whom the complaint is being filed
Does the complainant have to submit a physical copy also if the complaint is made by electronic mode?
If a complaint is filed electronically, hardcopy there shall be required to be submitted to the Lokpal of India within 15 days from the date of filing.
