ഫിനാൻഷ്യൽ അസറ്റുകളുടെ സെക്യൂരിറ്റൈസേഷനും പുനർനിർമ്മാണവും സുരക്ഷാ താൽപ്പര്യങ്ങളുടെ നിർവ്വഹണവും ആസ്പദമാക്കി 2002-ൽ ഇന്ത്യാ ഗവൺമെന്റ് നടപ്പിലാക്കിയ ഒരു നിയമമാണിത്. ബാങ്കുകളുടെയും ധനകാര്യ സ്ഥാപനങ്ങളുടെയും കിട്ടാക്കടങ്ങളായ  നിഷ്‌ക്രിയ ആസ്തികളുടെ (NPA) പ്രശ്നം പരിഹരിക്കുക എന്നതാണ് ഈ നിയമത്തിന്റെ ഉദ്ദേശ്യം.  

 

SARFAESI നിയമപ്രകാരം, വായ്പയെടുക്കുന്നയാൾ അവരുടെ വായ്പ തിരിച്ചടവിൽ വീഴ്ച വരുത്തുമ്പോൾ ഈടായി വാഗ്ദാനം ചെയ്യുന്ന ആസ്തികൾ കൈവശപ്പെടുത്താൻ ബാങ്കുകൾക്കും ധനകാര്യ സ്ഥാപനങ്ങൾക്കും അധികാരമുണ്ട്.  കോടതിയുടെ ഇടപെടലില്ലാതെ കുടിശ്ശിക തിരിച്ചുപിടിക്കുന്നതിനുള്ള നിയമപരമായ ചട്ടക്കൂട് ഇത് നൽകുന്നു.  കടം വാങ്ങുന്നയാൾക്ക് നോട്ടീസ് നൽകാൻ ഈ സ്ഥാപനങ്ങൾക്ക് ഈ നിയമം അധികാരം നൽകുകയും കുടിശ്ശിക തിരിച്ചുപിടിക്കാൻ ആസ്തികൾ വിൽക്കുകയോ പാട്ടത്തിനെടുക്കുകയോ ചെയ്യുന്നതിനും അനുവദിക്കുന്നു.

 

മൊത്തത്തിൽ, SARFAESI നിയമം ബാങ്കുകൾക്കും ധനകാര്യ സ്ഥാപനങ്ങൾക്കും അവരുടെ നിഷ്‌ക്രിയ ആസ്തികൾ കൂടുതൽ കാര്യക്ഷമമായി വീണ്ടെടുക്കുന്നതിനുള്ള ഒരു ബദൽ സംവിധാനം നൽകുന്നു.
