How do I revoke a power of attorney from India?

REGISTER THE “REVOCATION OF POWER OF ATTORNEY”

Generally, Power of attorney (POA) is executed in two types, they are

1. Local power of attorney (it means that POA executed and registered within India)

2. Foreign power of attorney (It means that POA executed & attested in foreign country)

Let me explain the revocation procedure for both types of POA.

Below is the procedure to revoke local POA:

Step 1: Prepare the revocation draft in word format. The draft looks like the below image.

Step 2: Print the draft on document paper

Step 3: Pay the government charges through K2 challan. Below are the government charges

• Stamp duty: Rs. 200

• Registration fee: Rs.200

• Scanning fee: Rs. 30 per page

(The above-mentioned rate and mode of payment are applies for Karnataka. Payment of stamp duty is state matter, the amount of stamp duty and payment method varies among states in India. )

K2 challan looks like the below image.

Step 4: Carry the following documents to sub-registrar office near you

• Revocation of Power of attorney (printed draft on document paper)

• Challan (government charge)

• Your ID proof

Step 5: Register the “revocation of power of attorney”

Sub-registrar takes photo and finger print. Executant and attorney sign the “Revocation Power of Attorney”.

This completes the registration of “revocation of power of attorney”.

Below is the procedure to revoke foreign power of attorney

Step 1: Prepare the revocation draft in word format. A draft looks like the below image

Step 2: Print the draft on normal A4 size paper

Step 3: Get the POA attested from Indian consulate or notary public in your country.

Step 4: Send the attested POA to India through reputed courier

Step 5: Your local assistance in India, should carry following documents to District Registrar office (DRO)

• Revocation of power of attorney (came from foreign)

• Stamp duty challan (which I shared above)

• Passport copy of executant

• Requisition letter (refer to the below mock)

Step 6: DRO adjudicates “revocation of power of attorney”. An adjudication looks like the below image.
