When i eventually did submit for the FMC I was informed I dont qualify as my father wasn't a government employee. Hence, was asked to go to the district courts and submit the application. On getting there, i was told i cannot submit the application as it requires to come through an advocate. On having sought the support of an advocate he came up with a complex mechanism and a 6% court fee for property value, which is not related to legal heir and we weren't selling property. Until now, i dont know how to acquire a legal heir certificate. Can someone be kind to guide because rules and procedures are never clear?

I am in the same boat. I have called several advocates and got several answers. What I understood so far is legal heir certificate is just a affidavit signed by you/your family members which the magistrate in court will certify. This does not affect ownership of property which still remains under the name of the deceased. There is a succession certificate which is a court order wherein all the movable. immovable properties get assigned by virtue of inheritance to all the legal heirs. If you need to sell a property, you will need to present the succession certificate and also have to get the property mutated at sub-registrar office to complete the ownership and selling process.
