രാജുവിന്റെ വീട്ടുവളപ്പിൽ നിൽക്കുന്ന ചില വൃക്ഷങ്ങളിൽ നിന്നുള്ള ഇലകൾ തൊട്ടടുത്ത വീട്ടിലെ വർഗീസിന്റെ കാർപോർച്ചിലെ ടൈലിൽ ചിലപ്പോഴെല്ലാം വീഴുകയും, അവർക്ക് ശല്യമാവുകയും ചെയ്യാറുമുണ്ട്. വൃക്ഷ ശിഖരങ്ങൾ കുറെയൊക്കെ വെട്ടിമാറ്റി പ്രശ്നം പരിഹരിക്കാൻ രാജു ശ്രമിച്ചിട്ടും "കാറ്റ്" വീണ്ടും പ്രശ്നങ്ങൾ ഉണ്ടാക്കുന്നുണ്ടായിരിന്നു.

രാജുവിന്റെ മരങ്ങൾ ജീവനും സ്വത്തിനും ഭീഷണിയാണെന്നും, മരം വെട്ടിമാ റ്റണമെന്നും ആവശ്യപ്പെട്ടുകൊണ്ട് വർഗീസ് പഞ്ചായത്ത് സെക്രട്ടറിക്ക് ഒരു പരാതി കൊടുത്തു. ഉടനടി മരങ്ങൾ മുറിച്ചു മാറ്റണമെന്ന് ആവശ്യപ്പെട്ടുകൊണ്ട് സെക്രട്ടറി രാജുവിന് നോട്ടീസ് കൊടുക്കുകയും ചെയ്തു.

ഒരു പൗരന്റെ ജീവനും സ്വത്തിനും അപകടകരമായി നിലനിൽക്കുന്ന മരങ്ങൾ മാത്രമേ കേരള പഞ്ചായത്ത്‌ രാജ് ആക്ട് സെക്ഷൻ 238 (1)(a) പ്രകാരം മുറിച്ചു മാറ്റേണ്ടതുള്ളൂ. ഇവിടെ രാജുവിന്റെ മരങ്ങൾ അപകടകരമായ രീതിയിൽ നിൽക്കുന്നതല്ല.
നിയമം ഇങ്ങനെയാണ്....

238 (1) (a) If any tree or any branch or portion of a tree or the fruits of any tree be deemed by the Village Panchayat to be likely to fall and thereby endanger any person or any structure or any cultivation, the Village Panchayat may by notice require the owner of the said tree to secure, lop or cut down the said tree or remove the fruits thereof so as to prevent any danger therefrom.

വർഗീസിന്റെ അപേക്ഷയിൽ നിയമപ്രകാരം തീരുമാനമെടുക്കേണ്ടത് പഞ്ചായത്ത്‌ ഭരണസമിതിയാണ്. ഇക്കാര്യത്തിൽ സെക്രട്ടറിക്ക് വിവേചനാധികാരം ഇല്ലാത്തതാകുന്നു. ആയതുകൊണ്ട് ഭരണാസമിതിയുടെ തീരുമാനമില്ലാതെ മരങ്ങൾ മുറിക്കുവാനുള്ള സെക്രട്ടറിയുടെ നോട്ടീസ് നിയമപ്രകാരമുള്ളതല്ല.
